1. Introduction

Welcome to SIMS (Sports Information Management System)! By registering as a member and using our facilities and/or the SIMS mobile application ("App"), you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding with registration or using our services.

2. Eligibility

To use the SIMS application and services, you must:

• Be at least 18 years old, or
• If you are a minor (ages 14-17), you may register only with explicit parental or guardian consent and supervision.

Memberships are personal and non-transferable. Each member is responsible for maintaining the confidentiality of their account credentials.

3. Membership and Payments

Membership fees are payable according to the selected plan (monthly, quarterly, or yearly) as displayed in the App. All payments are processed through secure third-party payment processors.

• Payments are non-refundable unless required by applicable law or as explicitly stated in your membership agreement.
• Failure to pay membership fees on time may result in suspension or termination of your membership and access to the App.
• Price changes will be communicated to you in advance, and you will have the opportunity to cancel your membership before the new pricing takes effect.

4. Cancellation and Suspension

Members may cancel their membership by providing at least 30 days' written notice through the App or by contacting us directly at info@sims.gr.

Suspension of membership is allowed for medical reasons upon submission of valid medical documentation. Suspended memberships will not be charged during the suspension period.

SIMS reserves the right to suspend or terminate any membership that violates these Terms and Conditions or engages in inappropriate behavior.

5. Rules and Conduct

All members must:

• Follow gym rules and staff instructions at all times.
• Wear proper sportswear and footwear while using gym facilities.
• Use equipment responsibly and return it to its designated location after use.
• Respect other members and maintain a safe, welcoming environment.
• Not share account credentials with others or allow unauthorized access to the App.

Any inappropriate behavior, including but not limited to harassment, violence, theft, or violation of gym rules, may result in immediate termination of membership without refund.

6. Health and Safety

Members are solely responsible for ensuring their physical fitness and ability to participate in gym activities. Before using our facilities, you should consult with a healthcare professional if you have any medical conditions or concerns.

By using the gym facilities, you acknowledge that physical exercise involves inherent risks, and you voluntarily assume all risks associated with your participation.

SIMS and its affiliated gyms are not liable for any injuries, accidents, or health issues that may occur during or after your use of the facilities.

7. Disclaimer of Liability

By using the gym facilities and/or the SIMS application, you acknowledge that you participate at your own risk. To the fullest extent permitted by law:

• SIMS is not liable for any injuries, accidents, or health issues resulting from your use of gym facilities.
• SIMS is not responsible for loss, theft, or damage to personal items brought into gym facilities.
• SIMS is not liable for technical issues, interruptions, or errors in the App that may affect your ability to access services.
• SIMS does not guarantee uninterrupted or error-free operation of the App.

8. Application Terms of Use

8.1 Access and Registration

• The SIMS application is intended exclusively for registered gym members.
• Users must provide accurate, current, and truthful information when registering.
• You are responsible for maintaining the security of your account and password.
• You must notify us immediately of any unauthorized access to your account.

8.2 Permitted Use

• You may use the App solely for personal, non-commercial purposes related to your gym membership.
• Access to certain features may depend on an active membership status.
• You may not use the App to violate any laws or regulations.

8.3 Prohibited Activities

• Unauthorized use, copying, modification, or distribution of the App or its content is strictly prohibited.
• You may not attempt to reverse engineer, decompile, or disassemble the App.
• You may not use automated systems or bots to access the App.
• You may not interfere with or disrupt the App's functionality or security.

8.4 App Availability

The App is provided "as is" without warranties of any kind, express or implied. SIMS does not guarantee that the App will be available at all times, free from errors, or compatible with all devices.

9. Intellectual Property

All content of the SIMS application, including but not limited to design, code, graphics, logos, text, images, and software, is the intellectual property of SIMS and is protected under applicable copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from the App without express written permission from SIMS.

10. Privacy Policy

Your privacy is important to us. This section explains how we collect, use, and protect your information:

10.1 Data We Collect

We collect the following types of information:

• Personal Information: Name, email address, phone number, date of birth, address
• Membership Information: Membership type, payment history, subscription details, attendance records
• Health Information: Age group, weight, medical conditions (if provided voluntarily)
• Payment Information: Processed securely through third-party payment processors (we do not store full credit card details)
• Usage Data: App usage patterns, device information, IP address, location data (if enabled)

10.2 Purpose of Collection

We use your data for the following purposes:

• Membership management and account administration
• Processing payments and managing subscriptions
• Providing access to gym facilities and services
• Communicating with you about your membership, classes, and important updates
• Sending app-related notifications and reminders
• Improving our services and App functionality
• Complying with legal obligations

10.3 Third-Party Services

We may use third-party service providers to assist in operating the App and providing services, including:

• Payment processors (e.g., Stripe, Google Pay, Apple Pay)
• Cloud hosting and data storage providers
• Analytics and performance monitoring services
• Push notification services (e.g., OneSignal)

Your data is shared with these providers only as necessary to provide services, and they are contractually obligated to protect your data.

10.4 Data Storage and Security

We implement technical and organizational measures to protect your data against unauthorized access, loss, alteration, or misuse, including:

• Encryption of data in transit and at rest
• Secure authentication and access controls
• Regular security assessments and updates
• Limited access to personal data on a need-to-know basis

However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

Under applicable data protection laws, including the General Data Protection Regulation (GDPR), you have the right to:

• Rectification: Request correction of inaccurate or incomplete data

The SIMS application complies with:

• Google Play Store policies
• Apple App Store policies
• Applicable local data protection laws

11. Service Availability

SIMS makes every effort to ensure continuous availability of the App and services but does not guarantee error-free or uninterrupted operation. The App may be temporarily unavailable due to:

• Scheduled maintenance or updates
• Technical issues or server problems
• Force majeure events beyond our control

Updates or maintenance may occur without prior notice. We will make reasonable efforts to minimize disruption to services.

12. Changes to Terms

SIMS reserves the right to update, modify, or amend these Terms and Conditions at any time. Significant changes will be communicated to users through:

• In-app notifications
• Email notifications (if you have provided an email address)
• Posting updated terms on our website

Your continued use of the App or services after changes become effective constitutes acceptance of the updated terms. If you do not agree with the changes, you must stop using the App and cancel your membership.

13. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Greece. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts of Thessaloniki, Greece.

14. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

If you do not agree with any part of these terms, you must not use the App or register for membership.
